Liability Waiver & Media Release

1. Participants represent they are physically and mentally fit for martial arts instruction. TJJW recommends consulting a physician. The organization does not warrant protective equipment or its effectiveness.
2. Participants consent to physical contact required during training and voluntarily assume any and all risk and loss that may occur. TJJW disclaims liability for injuries from negligence of owners, operators, employees, or agents.
3. Members agree to comply with all school rules and martial arts traditions upon receiving a copy of the agreement.
4. TJJW is authorized to use photos, videos, and media for advertising, promotions, social media, The Merge, DVDs, and websites.

Sparring Rules for Participation

1. Martial arts training involves contact and requires safety compliance. Participants waive claims against all persons and organizations related to sparring injuries.
2. Recommended protective equipment includes mouthpiece, elbow and knee braces, ankle wraps, protective cup, and headgear.
3. Immediate compliance to instructor commands is required. Participants must inform instructors of health or safety concerns.
4. Participants assume full responsibility and liability for all damages, injuries, and losses sustained while participating in or watching sparring.
5. Participants acknowledge that serious injury is commonplace in martial arts sparring and that even death is a possibility. They waive all claims against TJJW regardless of injury cause.
6. Safety measures may change, including due to COVID-19.
7. Members must follow academy policies regarding uniforms, footwear, and facility usage.

Representations

1. Participants represent they are in good health.
2. Participants will not participate while under the influence of drugs or medication.
3. No TJJW representative has made fitness representations.
4. Participants have read and understood all provisions.
5. Participants are legally competent to enter the agreement and understand they have forfeited substantial rights. This constitutes a complete and unconditional release of all liability to the greatest extent allowable by law.

Terms & Conditions

1. Failure to attend class does not cancel the agreement. Non-attendance does not relieve payment obligations for remaining tuition.
2. Program prices are subject to change. The agreement auto-renews unless terminated in writing at contact@trassojjw.com at least 30 days before term end. Upon renewal, pricing reflects then-published rates announced at least 30 days in advance. TJJW reserves cancellation rights.
3. Members assume responsibility for collection costs including agency fees, court costs, attorney's fees, and late charges.
4. School administrators may modify schedules without relieving payment obligations.
5. Schools may close for national holidays, special events, and up to four weeks annually for maintenance without affecting tuition payments.
6. Tuition is calculated on 4-week months or 48-week years.
7. Members grant permission for photographs, videotapes, artwork, or likenesses for marketing and lawful purposes.
8. Full tuition payment does not guarantee belt certification. Membership is non-cancelable and non-transferable. Failure to attend scheduled lessons relieves the school's obligation to provide lessons after program end.
9. Members authorize use of disclosed email addresses for billing, announcements, communication, and reminders, including financial information.
10. Members are prohibited from claiming commercial or marketing affiliation with instructors, TJJW, or Michael Trasso without written permission.
11. The prevailing party in legal action is entitled to costs and attorney's fees.
12. Members grant TJJW permission to add them to mailing lists for promotions and announcements.
13. Members were offered options to opt in or opt out of SMS messages regarding account status, payment updates, contract expiration, and appointment reminders.
